Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional.

What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

The Bill will also eventually force private insurance companies out of business,and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.

However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred,or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.

The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare a direct violation of the specific provisions of the 4th Amendment to the Constitution, information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.

If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However , that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.

So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law. It doesn't stop there though.

The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;

The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of
the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation to support the Constitution." If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.

For those who might doubt the nature of this threat, I suggest they consult the source, the U.S. Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

As we see,the law itself is being substantially changed as it is being instituted.All on executive order.Waivers and the like. Any IDIOT can see that any entity with lobbying power has received exemptions,waivers,and delayed implementation but the powerless,you and I,will be required to shackle ourselves to the oars.

It was never designed to succeed.It was designed to fail since as "the law of the land", Obama,as president,will be able to reconstruct it into it's final,desired form. Socialized medicine.

Repeal or de-funding HAD to be avoided at ANY cost and every lie has been told.Yet,the American people.as the polls show,blame the Republicans for the shut-down.This is why I will not ever vote again. The electorate have proven themselves to be too poorly informed to make simple decisions.They do not deserve my voting efforts and will have earned every single ill this monstrous law will bring.

Moon I am just appalled at the stupidity, Obamacare is probably the worst thing to ever happen, it is not affordable by any means and Obama knew this, he is killing the middle and lower class, now comes a Gov shut down, why start with programs that benefit children in nutrition and poverty level services ?? To me it is a scare tactic by the little boy in the White House not getting his way . The Repubs have brought to the table several bills that would have eased the crisis, and Obie, Reed and Nutso Nancy shot them down. I have friends getting letters of cancellation on ins. every day now. This whole mess backtrails to the White House. Show me one thing that is for the good of the people.

I think the strongest point being made in that article or at least, the strongest point that stands out to me is, parts of the health care plan are unconstitutional and somehow got passed anyway. The healthcare plans ultimate goal if you read into it is the transfer of power to the executive branch of government, and that my friends is nothing short of dictatorship, a dictatorship being the US government. When you consider that your health is a personal issue, and not one that should be decided upon and run by an uncaring, inhuman, insensitive robots like we all know the government CAN be, its a scary thought. What's even scarier is when you think about your healthcare cures and treatments will be decided upon more often that not, by federal bureaucrats and not by doctors, they will not be health care professionals. Where you once had Dr's making the decisions about the seriousness of your health issues, now will be made by nonprofessionals in the medical field, they will be pencil pushers and business suits, men and women who's real concerns are the financial well-being of the government office in which they work, and of course their own pockets. They don't want to lose their jobs because the office where they work is losing too much money, and the suits and pencil pushers are complaining about it, so they start declining requests from poeple to get medical treatment so they can patch up some business.

The writing is on the wall, its clear this is how it will play out. Your health issues will be treated in the same uncaring fashion like they sign-off on welfare checks and decline disability insurance checks. Its scary in that everyone gets old and their health starts to deteriorate, and they will have to face these a-holes making the decisions about your life. Your comfort is in the hands of the government.

Now I'm not a political man, never have been or claimed to know much or care about how this country is run, but that is my thoughts at this particular time.

This whole mess is spirling out of control, now death benefits are stopped for Veterans killed so far 17 have died since the shutdown and families have not recieved payment. Gets better VA checks will the delayed for Nov. The WIC program for low income children and pregnant mothers will end the last of Oct. Headstart schools are closing. This is the most useless President I have ever seen, I listened to his pathetic speech yesterday and the lies that came from his mouth were epic. It is either his way or no way and whatever it takes to break the American citizen he is willing to do and is doing. I hope all Democrats that voted for him are patting themselves on the back for electing a FOOL that preys on Veterans and children.

If Obamacare goes into effect you'll have to answer to an automated telephone answering machine. Just imagine that, push 1 to review your health benefits, press 2 to refill your prescriptions,  press 3 to talk to a doctor, press 4 if you are having an emergency, press 5 if you are dead.

I cannot believe the amount it will cost to be insured, nor the co-pays. Have they lost their friggin minds ?? Affordable hell no, no wonder all the Obama minions are exempt. My daughter a single parent will have to pay 397.00 a month for a policy plus a 6000.00 deductible. This is absurd. Now the Nut in Chief is skipping along on to immigration, while Obamacare is laying in a puddle of wasted money and a huge failure. He certainly is building a fine legacy for himself. At least the Blame Bush fools are silent, their prize whacko is destroying this all by himself. How nice a long time friend of Michelle's developed this train wreck , strange this woman is earning millions and it doesn't work and might not for 2 years. But Big O wants you to keep trying and lets not forget about the penalty at tax time. I love it that it was disclosed to Big O that it wasn't ready but the pouting little boy still rolled it out Oct 1st. What a total dumb ass.

She received a revision to her policy it will now be 475.00 w/ a 6000.00 deductible
